The pre-qualification and evaluation criteria vary from tender to tender and the detailed information on the criteria for pre-qualification and evaluation for each tender is set out in the specific solicitation documents for the tender.

The solicitations/requirements advertised in the daily newspapers and journals are also published on the Agency’s website https://www.lagosppa.gov.ng/#Tenders. Opportunities within the threshold and circumstances for restricted tendering are issued directly (electronically via the State’s e-procurement platform or manually) by the various Ministries, Departments and Agencies of government to vendors registered with PPA.

While you would receive notifications of available opportunities from the platform Licensee, please note that you will only receive electronic invitation to opportunities should the State Government require works, goods or services that your company provides and within the class for which your company is registered. Your company would also be required to meet certain prequalification criteria attached to each opportunity. Contractors are encouraged to actively seek out business opportunities advertised on the Procurement Agency’s website https://www.lagosppa.gov.ng/#Tenders.

The Lagos State Government recognises SMEs as the engines of socio-economic transformation and industrialisation, and in its commitment to their development specifically encourages SMEs to provide goods, works or services to the State Government. Furthermore, one of the objectives of the PPA is to create ample opportunities for small and medium scale enterprises to participate in the economic opportunities and benefits of public procurement. Opportunities are therefore open to any size of organisation. For specific assignments the State Government may require participants to demonstrate similar relevant experience commensurate to size and type of the assignment, a minimum turnover or company size to qualify; in such cases the advertisement/bid document will clearly request for documentation in this regard. Notably, organisations are only invited to solicit for contracts within the category and class for which they are registered and qualified.

Procuring entities may charge a reasonable fee reflecting only administrative and printing costs for a set of tender or prequalification documents.

All government entities which derive funds appropriated or proposed to be appropriated for any type of procurement described in this guidelines from Lagos State Consolidated Revenue Fund, Internally Generated Revenue, all grants /funds from donor agencies (where applicable), revolving funds, any funds generated from the Lagos State public on behalf of / through the Lagos State Government etc. are subject to the provisions of the Lagos State Public Procurement Agency Law 2015. Government entities include but are not limited to all public entities engaged in procurement in the State (Procuring Entities), namely the State Government, Local Government Councils/Development Authority, any public body in the State engaged in procurement, Ministries, Departments, Bureaus, Offices and Agencies of the State, extra-ministerial offices, parastatals and corporations.

You will be informed in due course if you have been short-listed or otherwise by the relevant Procuring Entity. At the end of procurement process, when the contract has been awarded, the contract details are published in the relevant section of the Agency’s website.

A Notification of Award is issued by the Procuring Entity to a successful Bidder notifying him of the decision of the Tenders Board to award the relevant contract to him and stating the obligatory fees he has to pay prior to the issuance of a substantive letter of Award.

Upon payment of the obligatory fees or communication of the contractor’s decision to have the said fees deducted at source, a Letter of Award is registered with PPA and issued to the Contractor.

The State is mandated to ensure that the organisations providing services to the state are corporately responsible and as such they are required to pay the Statutory Deductions and Levies applicable to every contract upon award to Limited Liability Companies. The general standard term of payment in the State is within 60 days of confirmation of satisfactory delivery of the goods or services. i.e. after full performance of the contractor’s obligations under the contract. However, in major more complex contracts, provision is normally made for progress payments on milestone achievements and this is clearly outlined in each solicitation document and Letter of Award. Payment methods depend upon the nature of the works, goods or services being provided are typically stipulated in the solicitation documents and Letter of Award.

P2P is a form of electronic (requisition and voucher) system to ensure that the contract and payments to be made on the contract are recorded in electronic format and also to encumber the money meant for the contract so as to avoid delays in payments, thereby ensuring timely completion of contracts.

The Lagos State Public Procurement Agency Law 2015 does not permit awarding contracts to companies permanently blacklisted or within the company’s period of blacklist. Only companies that are eligible for contract award are required to register with the State.

E-procurement is the use of internet technology to carry out procurement best practices as a means to streamline the purchasing processes, increase efficiency in the ordering process and reduce costs for both the Government and contractors.

The Lagos State Public Procurement Agency Law 2015 requires that the Agency maintains a database of service providers (contractors for goods, works, services{Consulting and Non-Consulting}) interested in offering some form of service or the other to the Lagos State Government, Local Governments and Local Council Development Areas. To this end every service provider interested in offering some form of service or the other to the State must have completed the registration process with the Lagos State Public Procurement Agency (“the Agency”/“PPA”) and have a Certificate of Registration from the Agency.

Participating contractors can realise many benefits from online or e-procurement, including: • Increased visibility and access to markets without additional marketing efforts; • A single point of access to Government procurement; • Faster and more efficient tendering; • Increased order accuracy through electronic ordering; and Overall, e-procurement brings to the contractor cost reduction in process, marketing, and administrative operations.

E-tendering refers to the electronic advertising of requirements for good or services, registering suppliers, issuing and receiving tender documents and evaluating responses electronically, on the Agency website (http://www.lagosppa.gov.ng)

Access to e-tendering is only available to contractors registered with the PPA on the electronic (e-registration) platform. An electronic invitation notification ‘Invitation to Bid’ will be sent to the email you utilised while registering as a service provider (contractors for goods, works and/or services) with PPA. The email contains links which bidders can use to access the e-tendering platform to bid. Once a bidder accesses the e-tendering platform to commence the bidding process, the system will direct the bidder with further links and /or prompts (save, next, save and next, etc), which are user friendly and easy to follow to submit bids via e tendering.

You can register as a contractor with the State by clicking on ”Register Now” found on the Vendor Registration Portal on the Lagos State Public Procurement Agency website(http://www.lagosppa.gov.ng) and filling the Registration Form. Public Procurement opportunities, to provide works, goods and services (i.e. bid opportunities) are advertised in a wide range of media including the following: • Notices placed on the Notice Boards of Ministries, Parastatals and other Procuring Entities. • Newspapers and other print media (both local and international) • Individual Public Procuring entities’ websites • The online Tenders Journal available on the PPA website www.lagosppa.gov.ng • Lagos State Government website www.lagosstate.gov.ng The form of advertisement will depend on the size, complexity and monetary threshold of the goods, works or services being procured. However, opportunities within the threshold and circumstances for restricted tendering are directly issued (electronically via the State’s e-procurement platform or manually) by the various Ministries, Departments and Agencies of Government to vendors that are registered with the PPA and have received your Certificate of Registration.

All procurement opportunities (Invitations to Bid, Expression of Interest and Requests for Proposals) are published and available on the Agency’s website https://www.lagosppa.gov.ng/#Tenders. However, some opportunities within the threshold and circumstances for restricted tendering are issued directly (electronically via the State’s e-procurement platform or manually) by the various Ministries, Departments and Agencies of government to vendors registered with PPA.

The State is governed by fairness, transparency and accountability in its procurement process; open tendering is the norm whilst alternative processes maybe used under certain circumstances. These include: Restricted tendering may be used – • where Contractors have already been prequalified; • where there are time or cost constraints; • where there are only a few known suppliers for the required goods, works or services; • where the value of works, goods or services is of low value; • where the required works, goods or services is of a very complex nature; and • Where the cost of the required works, goods or services negates the cost of implementing the open competitive process. Direct contracting may be used – • where there is only one person or company that can supply the works, goods or services being procured, • where there is no reasonable alternative, or in certain cases of urgent need; • where emergency procurement is required; • where there is a need for the continuation of an existing award/contract • based on other Guidelines set by the Agency
